Clinton Couple Receive Animal Cruelty Charges

A Clinton couple were arrested late last month and both received cruelty to animal charges in Custer County District Court after multiple dogs were found in poor living condition on the suspect’s property back in May.

According to a probable cause affidavit, the City of Clinton’s Animal Control Officer observed six dogs in cages behind a residence in the 100 block of Petty Lane on May 16.

After investigating, the officer discovered eight dogs in total on the property that allegedly did not have clean water and with various amounts of feces in the their kennels.

The affidavit stated that the officer met with one of the owners, 34-year-old Clayton Joseph Allison, who could not provide up-to-date vaccination records for the dogs.

He was advised that he needed to clean the living conditions of the dogs and provide them with adequate food and water.

The affidavit said that a few days later, while doing a follow up on the property, the officer reported that the conditions had not improved. In fact, it was reported that the dogs’ health had declined with them showing to have lost a significant amount of weight.

It was then determined that the dogs needed to be seized due to their poor condition. While at the residence, a woman identified as 47-year-old Tonya Kim Powell came out of the residence and identified herself as Allison’s wife.

Powell allegedly claimed responsibility for one of the dogs and was asked if the dogs had been vaccinated in the last two weeks and Powell told said no.

After taking possession of the dogs, they were sent to a local veterinarian for treatment. It was reported that after two weeks a check of the progress of each dog showed that hey had gained weight and their conditions were improving.

Both Allison and Powell are due in court for preliminary hearing conferences next month.
