Elk City, OK – An Elk City man has been arrested and charged with kidnapping after police say he took a 10-year-old girl without permission and transported her to multiple locations around town while intoxicated.

According to a probable cause affidavit filed in Beckham County District Court, officers responded to a call on August 30 at an Elk City residence involving a missing child. The reporting party told officers that 38-year-old David Aguilar Guzman had picked up the girl and taken her without authorization.

Police said the child pointed directly at Aguilar when asked who had brought her, and she appeared very upset and crying. She repeatedly asked officers to take her to a fast food restaurant where her grandfather was working.

Investigators confirmed the child’s family members had not given Aguilar permission to take her. Other guardians also told officers they never authorized Aguilar to have custody of her.

Officers later determined Aguilar had been drinking at a residence before driving the child around Elk City in a small car. Police say Aguilar admitted he was intoxicated during his interactions with them.

The affidavit states Aguilar took the girl to at least three different locations, including his home, his workplace, and finally to the residence where officers located them.

Aguilar was arrested on a felony kidnapping complaint and booked into the Beckham County Jail. His bond was set at $50,000. A condition of release prohibits him from contacting the child or her parents.

His next court date is scheduled for October 27 in Beckham County District Court.
