A California man was charged Wednesday in Custer County District Court after allegedly hitting a Clinton Police Office.

According to online court records 24-year-old Nicholas Elijah Furr of Sebastopol, California received one felony charge of assault and battery upon a police officer after being arrested for the incident that took place on Tuesday.

A probable cause affidavit revealed that police were responded to a disturbance call Tuesday afternoon that stated a man was seen kicking pumpkins in the 700 block of Gary Boulevard. Police would eventually locate the suspect in the 1400 block of Gary Boulevard, sitting on a sidewalk curb, drinking an alcoholic beverage.

Police say when they tried to make contact with the suspect, he began to walk away. After police gave verbal commands to stop, police would grab Furr’s arm, at that time police say Furr balled up his fist and swung his left arm – striking the officer in the nose with his forearm.

Eventually Furr was tased by another officer and placed under arrest.

The officer who was struck by Furr did not need medical attention.

A preliminary hearing for Furr has been scheduled for October 29.
