Jones Trail Delayed Until April 2023

The murder trial for an Elk City man accused of killing a 2-year-old boy in 2021 has been delayed.

In a court order issued on Wednesday, now the trial of 26-year-old Troy Justice Jones will commence in the first week of April.

In the order obtained by Paragon Communications, it stated that on December 5 the State provided notice to the court and the defense of potential evidence that could be considered mitigating or exculpatory evidence for the defense. On December 6 the court reviewed the information and ruled the same to be discoverable and that the evidence must be turned over to the defense. The defense pointed out that they filed their specific request for the State to provide such information over a year ago, on September 20, 2021, with many follow up requests in the fifteen-month period thereafter. However, the information was not provided by the State until five days prior to the trial, which was slated to begin on December 12.

The judge stated that she did not fault the prosecution for withholding the evidence from the defense, stating that the District Attorney’s office to be overworked and understaffed at the moment. The order also praised the defense for their swift action, stating that instead of using the fact of obtaining the evidence a week before the trial and using that fact to possible file an appeal afterwards, they chose to alert the court.

The document concluded by saying the next jury term is April 3 and the court would reserve two weeks for the trial.

Jones was charged in January 2021 with first-degree murder, child abuse after being accused of abusing a 2-year-old boy that resulted in the child’s death.
