The wrongful death lawsuit in Custer County District Court filed against a Weatherford nursing home has been dismissed.

According to court records, the lawsuit filed against Corn Heritage Village was dismissed last Thursday (March 18) by District Judge Jill Weedon after attorneys for the plaintiff filed a motion for dismissal.

The lawsuit came to the attention of the administrator of the nursing home in February after seeing it in a local news publication. In fact the administrator was also named in the lawsuit that claims the plaintiffs mother died of a bowel obstruction due to negligence of the nursing home.

The plaintiff was seeking monetary compensation.

However, when speaking with Paragon Communications last month, the administrator says the woman was never a resident of Corn Heritage Village, and thus the lawsuit was filed with misinformation and inaccuracies and, therefore, is without merit.

The administrator also said he was never served in the lawsuit.

It is unclear where the woman was a resident at, or even if the plaintiff – the woman’s daughter – was or is a Weatherford resident. Court records show both of the lawyers representing the plaintiff are not from the western Oklahoma area. One from Edmond, the other from Grapevine, Texas.
