Clinton Man Charged with Rape

An arrest warrant has been issued for a Clinton man on a charge of second degree rape of a 14-year-old girl.
According to a probable cause affidavit, 22-year-old Isaac Lee Arriaga had allegedly promised the young girl a cell phone in return for having voluntary sex with him. 
What got Arriaga in trouble, however, was that he didn’t come through on his end of the bargain, providing the phone to the girl.
The court document says the teenager’s mother found out about the alleged incident when she discovered a note her daughter had written to Arriaga complaining that he hadn’t provided the promised “touch screen” phone for her.
She then confronted her daughter who allegedly said that she had, indeed, written the note and had sex with Arriaga about three weeks earlier in a nearby residence.
According to the probable cause affidavit, the note read, “Alright you need to keep your promise!”  I need a phone!  I had sex with you even though I didn’t want to.”  It also said, “Keep your promise or we’re over cuz I hate liars and users…or I’ll never have sex with you ever, every again.”
Arriaga is charged with rape in the second degree even though the alleged sexual act was consensual given that it’s illegal for an adult to have sex with someone underage.
According to the Custer County Jail, Arriaga hasn’t been incarcerated yet, but an initial bond of $50-thousand dollars has been set by Special District Judge Donna Dirickson.
