OKC Man Accused Of Drunk Driving – Young Kids In Vehicle

An Oklahoma City man was arrested and charged in Custer County recently after he was suspected of driving while drunk with three minors in the vehicle.

According to a probable cause affidavit, an Oklahoma Highway Patrolman pulled over 27-year-old Edgar Ochoa Acosta on I-40 in Custer County on December 20th, after the trooper observed the vehicle he was driving drift partially onto the shoulder for several seconds before drifting back to its lane, and then back over onto the shoulder for several more seconds. The affidavit stated that once the trooper activated it’s emergency lights, the vehicle was slow to respond to the lights, and slow to pull over.

The court document stated that when the trooper made contact with the driver, he observed 3 small children, later determined to be a set of 2 year old twins, and a 1 year old, in the back seat, not secured in car seats.

The trooper stated that he allegedly observed a strong odor of alcohol coming from Acosta and that the suspect failed a field sobriety test.

Acosta was arrested and booked into the Custer County Jail and charged with, among other things, operating a vehicle while impaired by alcohol, and child endangerment.

Acosta’s first court date is an attorney date set for January 13th, followed by a preliminary hearing on January 24th.
